2. SCOPE OF AGREEMENT

These Terms of Sale govern:

  • Online purchases made through the Website

  • Payment, shipping and delivery

  • Customs and import duties

  • Returns and cancellations

  • Rights and obligations of both parties

By placing an order, the customer (“Customer”) agrees to these Terms.

3. ORDER FORMATION

A binding contract is formed once:

  1. The Customer completes checkout, and

  2. Payment is successfully processed, and

  3. An order confirmation is issued.

The Seller reserves the right to refuse or cancel orders in cases including but not limited to:

  • Pricing or system errors

  • Stock unavailability

  • Fraud suspicion

  • Shipping restrictions

  • Regulatory limitations

If cancelled, any paid amount will be refunded.

4. PRODUCTS & PRICING

Product descriptions, materials, images, and prices are displayed on the Website.

  • All prices are shown in the selected currency.

  • Final payable amount is shown at checkout.

  • Shipping costs are calculated at checkout unless stated otherwise.

  • Promotions are subject to availability and may be withdrawn.

Minor variations in color or texture may occur due to screen differences or handmade characteristics.

5. PAYMENT

Accepted payment methods are displayed at checkout.

Payment processing is handled by third-party providers. The Seller does not store full credit card information.

The Seller may conduct fraud verification checks and request additional confirmation if necessary.

6. SHIPPING & DELIVERY

6.1 Delivery Model – DAP (Default)

All shipments are made under DAP (Delivered At Place) unless explicitly stated otherwise at checkout.

Under DAP:

  • The Seller covers shipping costs to the destination country.

  • The Customer is fully responsible for:

    • Import duties

    • VAT/GST/sales tax

    • Customs clearance charges

    • Brokerage fees

    • Any other local import costs

The carrier may contact the Customer for customs clearance. Failure to respond may result in return or destruction of goods.

6.2 Optional DDP

The Seller may apply DDP (Delivered Duty Paid) in specific markets or promotional periods.
If DDP applies, this will be clearly indicated at checkout.

7. CUSTOMS & IMPORT RESPONSIBILITY

The Customer acts as the importer of record (under DAP shipments).

The Customer must provide:

  • Any required identification or tax information

  • Customs documentation if requested

If a shipment is:

  • Refused

  • Not collected

  • Not cleared through customs

All return shipping, customs penalties, duties, and related fees will be the responsibility of the Customer and may be deducted from any refund.

8. CANCELLATIONS

Orders may be cancelled before shipment.

Once shipped, cancellation becomes a return request and is subject to the Return Policy.

9. RETURNS & REFUNDS (GENERAL FRAMEWORK)

The detailed procedure is governed by the separate Return & Exchange Policy, which forms an integral part of these Terms.

9.1 Customer-Initiated Returns

Except in cases of defective or incorrect items:

  • All return shipping costs

  • Customs charges

  • Import/export duties

  • Carrier fees

are fully borne by the Customer.

These costs may be deducted from the refund amount.

9.2 Defective or Incorrect Products

If the product is defective or incorrect, the Seller will provide:

  • Replacement, or

  • Partial refund, or

  • Full refund

at its discretion.

The Customer must notify the Seller within 48 hours of delivery with supporting evidence (photos/videos).

10. RISK TRANSFER

Risk of loss transfers to the Customer upon delivery to the specified address.

The Seller is not responsible for delays caused by:

  • Customs authorities

  • Carrier disruptions

  • Incorrect address information

  • Force majeure events

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • The Seller shall not be liable for indirect, incidental, or consequential damages.

  • The Seller’s total liability shall not exceed the total amount paid for the relevant order.

Nothing in these Terms excludes liability that cannot legally be excluded.

12. FORCE MAJEURE

The Seller is not liable for failure or delay caused by events beyond reasonable control, including but not limited to:

  • Natural disasters

  • War

  • Pandemic

  • Government restrictions

  • Customs actions

  • Carrier interruptions

13. INTELLECTUAL PROPERTY

All Website content including logos, product designs, images, and text are protected by intellectual property laws.

Unauthorized use is prohibited.

14. PRIVACY

Personal data is processed in accordance with the Website’s Privacy Policy.

15. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of the United Arab Emirates (Dubai).

However, if the Customer resides in a country where mandatory consumer protection laws apply, such mandatory provisions shall remain unaffected.

Any disputes shall be subject to the competent courts of Dubai, unless mandatory consumer laws provide otherwise.

16. MODIFICATIONS

The Seller may update these Terms at any time.

The version in force at the time of order shall apply to that order.
